Temporary Orders in Iowa Divorces

The court may order either party to pay the clerk for separate support and maintenance of the other party and the children and the enable the other party to finance the divorce action. The court may also determine temporary custody of any minor children whose welfare may be affected by the divorce filing. (IA Code 598.12) A temporary order for custody will provide a minimum visitation schedule with the noncustodial parent (the parent with whom the children do not live) unless visitation is not in the best interests of the children.

In making temporary orders, the court considers the following:

  • age of the applicant
  • physical condition of the parties
  • financial condition of the parties
  • statements of income
  • other relevant information contained in affidavits

The temporary order will stay in place until the final decree or until a modification or dismissal is ordered due to changed circumstances made by the court on application of either party.
